Participant understands and acknowledges that mountain biking, nordic skiing, fat biking, trail running, snowshoeing, and any other recreational use of the Facility (the “Activities”) involve inherent, obvious, and known risks. Participant understands that the Facility may contain unmarked hazards, that trail conditions may change at any time, and that emergency response services may be delayed or unavailable. Participant freely and voluntarily assumes all risks, known and unknown, associated with the Activities and the use of the Facility, including risks arising from the negligence of NMCT except to the extent such negligence cannot legally be waived. To the fullest extent permitted by applicable law, Participant hereby waives, releases, and discharges NMCT from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, whether known or unknown. Participant agrees to: Follow all posted signs, trail markings, and instructions of Facility personnel; Use equipment in good working order and appropriate for the Activities; Wear a properly fitted helmet while mountain biking and appropriate safety gear for all Activities; Refrain from entering closed trails or restricted areas; and Exercise reasonable judgment and control at all times. Participant acknowledges that they: have read and understand this Agreement; are signing it voluntarily; understand that they are giving up substantial legal rights; and agree to be bound by its terms.
